After completing this course, you'll be able to analyze an insurance policy.

Upon successful completion of this course, you should be able to:

  • Describe the following distinguishing characteristics of insurance policies:
    • Indemnity
    • Utmost good faith
    • Fortuitous losses
    • Contract of adhesion
    • Exchange of unequal amounts
    • Conditional
    • Nontransferable
  • Explain why some insurance policies do not have the distinguishing characteristics common to most insurance contracts.
  • Explain the role of the courts in resolving coverage disputes:
    • Compare questions of liability and questions of coverage.
    • Compare questions of law and questions of fact.
  • Describe waiver and estoppel.
  • Describe an insurer's alternatives in coverage disputes regarding property claims and liability claims.
  • Describe the damages and other penalties that may be assessed against an insurer in a coverage dispute.
